His decision came after the supreme Court of Cassation on Monday night upheld his conviction to four years and two months in prison.
The sentence was for the Viareggio train disaster that killed 32 people in 2009.
His lawyer said it was “not fair that someone should go to jail after 15 years for a culpable offence”.
The Cassation also ordered a third appeal trial for Mauro Moretti, former managing director of Ferrovie dello Stato and the RFI network company, who was sentenced to five years in the second appeal trial.
The high court ordered that Moretti’s sentence be recalculated and his lawyer said he should avoid jail time.
