The sentence concerned the case of a man named only as ‘C.C.’ who had been arrested for suspected drug crimes and died of an overdose while in police custody in Milan.
The Court found that the Italian government had failed to provide convincing arguments or evidence to show that sufficient steps - such as searches or medical assistance - had been taken to protect the man’s life while under arrest.
The judges ordered Italy to pay 30,000 euros in moral damages to the man’s mother, partner and daughter.
