The city stopped the transcriptions of birth certificates in such cases earlier this year after the interior ministry warned local councils against doing this when the child is born thanks to surrogacy, a practice that is illegal in Italy.

Many gay Italian couples have had children with the help of surrogate mothers in countries like Spain and the US where the practice is legal.

“The Milan council will finally be able to resume the transcriptions of the birth certificates of minors born abroad with two dads, although only with the biological parent named,” Sala said in a video on Facebook.

He added that the move followed the response from the interior ministry to a question about the legality of the procedure.

Last week the Lower House approved a bill that would make surrogacy a universal crime.

The controversial measure, which has moved to the Senate and was presented by the centre-right majority, would make it possible to prosecute Italians who resort to using surrogate mothers abroad.
