The investigation was opened after Cappato handed himself in to Carabinieri police on Tuesday, and he could face up to 12 years in prison for his assistance in the suicide.
Fabiano Antoniani, otherwise known as DJ Fabo, decided to die on his own terms, passing away at the age of 40 on Monday following an assisted suicide procedure in Switzerland.
"He chose to go respecting the rules of a country that is not his,” Cappato said.
On January 19, 2017, Antoniani appealed to President of the Italian Republic Sergio Matarella for the right to die without suffering.
After receiving no response from the government of Italy, where euthanasia and assisted suicide are illegal, Antoniani took matters into his own hands.
Accompanied by Cappato, he travelled five hours by car to arrive at a clinic in Switzerland where he would end his life.
Antoniani said his final goodbyes in a video posted on Twitter shortly before he passed away, thanking Cappato for helping him to be free from his “hell of pain”.
"Finally I am in Switzerland and, unfortunately, I got here on my own strength and not with the help of my country," Antoniani added, hoping that change will come for future generations.
